Terms of use


1.1 - The present general conditions of sale (hereinafter "GTC") apply to the website of the online store OLLY GAN (hereinafter the "Website") as well as to orders placed on the Website.

1.2 - Please read the GTC carefully before placing your order on the Website. Access to certain parts of the Website as well as orders placed on the Website are subject to the application of these GTC. We advise you to make a copy of these GTC for future reference. 1.3 - These GTC apply to Metropolitan France and are available only in French.


2.1 - Your order implies the acceptance of our offer and in particular the acceptance of the proposed price and the designated products. As a result, when you confirm your order, you agree to be bound by the sales contract.

We are committed to honouring the orders we receive within the limits of available stocks. If the product you ordered is no longer available, we will notify you and we will cancel your order for the product that is no longer available. In the event that only some of the products ordered are no longer available, we will process the order for the available products and will inform you in the "Delivery email" of the unavailability of other products. The order of products that are no longer available will be cancelled if necessary.

The processing of the order is subject to the validation of your payment.

If your payment is not validated by the credit card issuer, if it should prove to be fraudulent, or in case of reasonable suspicion of fraud, your order will not be processed and will be automatically cancelled.

2.2 - If you do not comply with the provisions of these GTC and in particular the provisions of Article 8 (3) which requires that the goods delivered be returned in their original state, or if you have not respected a payment to Olly Gan regarding any of your orders, Olly Gan reserves the right to refuse future orders.


3.1 - If you wish to select items from our collection of products, click on "Add to cart" to add them to the "Cart & Payment" section. When you have completed your shopping cart, you agree, by clicking on "Proceed to payment", to purchase all items in the shopping cart. By accepting our offer, the contract of sale is concluded and you are bound by this contract.

3.2 - Before placing an order, you can at any time check and modify the details of your orders by clicking on "Cart & Payment".

3.3 - When you have placed an order, you will automatically receive an email confirming your order ("Confirmation Email") that sets out the details. We recommend that you print this email and keep it. This email confirms that we have received your order.

3.4 - We remind you that these GTC apply to Metropolitan France and as such, Olly Gan does not accept orders whose place of delivery is located outside of the French territory. These GTC also do not apply to overseas departments and territories.

3.5 - Once your items have shipped, a second email will be sent to you ("Delivery Email") which will indicate the date on which the items will be delivered.


4.1 - In order to simplify the orders on our Website, we suggest that you create a personal account. If you take advantage of this opportunity, all personal data that you provide us with during the process of creating the account will be stored in our database so that you will not have to provide it with each new order. Your data will be automatically entered in the order form.

4.2 - In order to register, you must provide the following information using the online registration form: last name, first name, address, date of birth, email address and, if applicable, the delivery address if it is different. This information will be stored in our database in accordance with the data protection conditions that can be changed [HERE].

4.3 - After creating your personal account, an email will automatically be sent to you confirming that your account has been created. Your email address will serve as your login ID. When saving your account, you will be asked to create a password. You will be able to modify it when logged in to your account. Keep your login ID and password secret and do not share then with an unauthorised third party. You alone are responsible for the fraudulent use of your login ID and password.


5.1 - The probable delivery time of the items you have ordered will be indicated in the Delivery Email. The delivery time is generally from two to four working days following the date of the Delivery Email. The products you ordered will be delivered to you by the date indicated in the Delivery Email.

5.2 - Although we do our best to deliver your order by the date indicated in the Delivery Email, the delivery may take longer than expected. In the event that we cannot meet the delivery date indicated in the Delivery Email, we will notify you as soon as possible and will indicate a new delivery date. However, if the delay should exceed ten days, you have the option to cancel your order within a period not exceeding 30 working days. Should you receive your purchase after your cancellation request, we will refund the ordered items as soon as they are returned to us, in their original condition.

5.3 - If you have placed multiple orders, we may need to make multiple deliveries. If this is case, you will be notified in advance.

5.4 - Once the articles purchased are delivered, they become your responsibility.


6.1 - The prices listed on the Website include taxes. OLLY GAN reserves the right to modify prices at any time but products are billed based on rates in effect at the time that the order is placed.

6.2 - The prices listed on the Website exclude shipping costs. Free delivery starting at €80 worth of purchases.  If you decide to cancel your order and return the items to us, return shipping costs are free.

6.3 - There are no shipping costs for orders sent to Ollygan stores.


7.1 - Payment for ordered items must be made by credit card as indicated at the time of payment. We accept the following credit cards: Visa/CB/Eurocard and Mastercard. All purchase transactions take place within a strict framework of confidentiality and encryption in line with the SSL protocol.

In line with our commitment to payment security, we verify the reliability of the information entered when processing an order. This initiative is part of our fight against internet payment fraud and hence protects our consumers.

7.2 - The full price will be charged to your card at the time that your order is processed and before shipment.

You must certify that you are the owner of the credit card being used. Authorisations are carried out by the issuer of the credit card. If the card issuer rejects the payment authorisation, your order will not be processed and we will not be held responsible for the delay or the absence of delivery. In addition, we are not obliged to give you the reason for this refusal.


8.1 - If for any reason you are not satisfied with your purchase, you have the right to return your items and receive a full refund. Return postage is free of charge.

8.2 - Returns can be made within 14 days following the receipt of your order by sending a written notification.

8.3 - You may claim a full refund for your returned products provided that:

a) purchased items and the return form are sent to: Sté SPAG OLLY GAN, Actimart II – Pôle d’Activités des Mille- 1140, Rue André Ampère 13851 Aix-en-Provence Cedex 3, in the 14 days following the receipt of your purchase;

(b) items are returned in their original condition, without being damaged, washed, altered or worn, and the original packaging, accessories and/or directions for use are also returned.

8.4 - We will refund your payment in full to the credit card used for your order, within thirty days of the receipt of returned items in accordance with Article 8 (3) (b).

8.5 - We ask that you take care of the items in your possession and return them to the address indicated in Article 8 (3) as soon as possible after the cancellation of your order.

8.6 - Please note that if you do not take care of the items or fail to return them to us, we will take legal action against you for damages. We also reserve the right to exclude you from further use of our Website.

8.7 - If we have not received your items within a reasonable time frame after your cancellation, we reserve the right to send a courier to the delivery address to recover them. Expenses incurred for the recovery of items will be at your charge.

8.8 - OLLY GAN is under no obligation to accept returns nor to refund items that do not meet the conditions described in Article 8 (3) (b). Items not accepted by OLLY GAN will be returned to you.


9.1 - If the items you ordered have a defect or do not correspond to the description given on the Website, please contact us as soon as possible at service-client@olly-gan.fr. Please return the defective products with the return form and we will either replace them if they are available or provide you with a full refund.


10.1 - Personal data

In line with the Data Processing and Liberties Law of January 6, 1978, you have the right to access, modify, rectify and delete any personal data. You can exercise this right by sending us an email to the following address: SAS SPAG – OLLY GAN

You can also access or modify your personal data in “My Account”. The automated processing of personal data on the site www.ollygan.fr has been declared to the Commission Nationale Informatique et Libertés under the number 1461535.

10.2 - Cookies

The user is informed that during visits to the Website, a cookie may be automatically installed on his/her browser. A cookie is an element that does not identify the user but is used to record information relating to his/her navigation on the Website. The user may disable cookies directly in his/her browser settings.


11.1 - We cannot be held liable for any loss or damage that may be caused to you when said losses and damages could not be reasonably foreseen, whether by you or by us, at the time of acceptance of these GTC (including a case where the loss or damage results from a violation of said GTC). Reasonably foreseeable losses or damages are those which you or we could have foreseen.

11.2 - We also cannot be held liable for any loss or damage that may be caused to you if your online purchases are intended for resale, for commercial purposes or for any other purpose other than those provided for in Article 2 (3).

11.3 - We

a) cannot be held responsible for damage to your computer system or loss of data resulting from the use of our Website;

b) do not guarantee the availability of content and services on the Website. All content and services are subject to availability.

c) do not guarantee that the Website can be accessed continuously and operationally nor that the information available on the Website does not contain errors or omissions (however, as soon as such errors or omissions are brought to our attention, we will correct them as soon as possible).

11.4 - When placing an order on our Website, our liability for any loss or damage that may be subject to these GTC is limited, for each complaint, to the purchase price of your order.

11.5 - We cannot be held responsible for delays or breaches of the obligations provided for in these GTC if said delays or breaches occur due to an event beyond our control. Such events include, but are not limited to, the paralysis of transport infrastructure, government intervention, wars, civil insurrections, the taking of hostages, fires, floods, accidents, storms, strikes, terrorist attacks or any industrial event likely to affect our service or that of our suppliers.


12.1 - The use of the Website does not grant you any copyright, design, trademark rights or any other intellectual property rights (nor intellectual property rights belonging to third parties).

12.2 - The Website is intended for your private and non-commercial use. The content of the Website may not be used for any purpose other than that previously set forth without our express written consent.


13.1 - In case of changes to these Terms and Conditions, we will notify you on our Website. An informational message asking you to accept these new terms and conditions will appear at the time of purchase.

13.2 - The orders/sales done through our Website, as well as the present GTC are subject to French law, and any litigation which could amount from the aforementioned orders/sales are subject to the non-exclusive competence of French jurisdictions.

13.3 - In the event that one of the provisions of the present GTC is deemed invalid or illegal, the validity and legality of the other provisions will not be affected.
